Boxercise gains European Trademark

Boxercise plans to take its training courses overseas after being awarded the European Trademark for the name Boxercise in addition to its existing British Trademark.

It means that no one can use the name in Europe unless having completed a Boxercise instructor course.

Boxercise director Andy Wake said: “For far too long unscrupulous instructors have assumed that they can teach a Boxercise class or personal training session without having the formal qualification. This is of course breaking the law by breaching our statutory rights. We defend out trademark very seriously and will take legal action against any instructor using our name without permission.”

The company is currently in the process of taking a Cardiff instructor to court for using its name without permission. “Instructors have to be aware that under English Law ignorance is no excuse, just because they are unaware a trademark exists does not allow them to breach it,” says Wake.
